These terms and conditions apply to all orders placed by consumers through our KBazar online grocery website operated by Fein & Fair, Balinger str. 1, 70567 Stuttgart, +4915901784015, info@kbazar.de.
The presentation of goods on our Website does not constitute a binding offer to conclude a purchase contract. Rather, it is a non-binding invitation to the Customer to place an order.
The Customer can place an order by adding the desired items to the virtual shopping cart and completing the order process. By clicking the “Order Now” button, the Customer submits a binding offer to purchase the goods in the shopping cart.
We will immediately confirm receipt of the Customer’s order by email. The confirmation of receipt does not constitute an acceptance of the offer. We reserve the right to reject the offer without giving reasons.
A binding contract is only concluded when we send the goods to the Customer and confirm the shipment by email.
The prices stated on our Website are inclusive of statutory value-added tax and any other price components. Shipping costs are not included in the prices and will be displayed separately during the ordering process.
Payment can be made by the payment methods displayed on our Website. We reserve the right to exclude certain payment methods in individual cases. If payment is made by credit card, the credit card will be charged immediately upon completion of the order.
Currently, delivery is only possible within Germany. We will deliver the goods to the delivery address provided by the Customer during the order process.
The delivery time depends on the selected delivery method and will be communicated to the Customer during the order process. If we are unable to meet the agreed delivery date, we will inform the Customer immediately and provide a new delivery date.
The Customer has the right to withdraw from the contract within fourteen days without giving any reason. The withdrawal period begins on the day on which the Customer or a third party named by the Customer, who is not the carrier, takes possession of the goods.
To exercise the right of withdrawal, the Customer must inform us (Fein & Fair, Balinger str. 1, 70567 Stuttgart, +4915901784015, info@kbazar.de) of the decision to withdraw from the contract by means of a clear statement (e.g. a letter sent by post, fax, or email).
In the event of a valid withdrawal, we will refund the purchase price already paid by the Customer immediately, but no later than within fourteen days after receipt of the notice of withdrawal.
We are liable for damages resulting from injury to life, limb or health as well as for damages resulting from intentional or grossly negligent breach of duty or fraudulent intent. Liability under the Product Liability Act remains unaffected.
In all other cases, our liability is limited to the foreseeable, typically occurring damage. The liability for slight negligence is excluded.
The law of the Federal Republic of Germany shall apply exclusively. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contractual relationship is our registered office.
If individual provisions of these T&Cs are invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, a provision shall be deemed agreed that comes closest to the intended purpose of the invalid provision.
